This website is operated by Thrive Outlet, a division of Thrive 3PL LLC ("Thrive," "we," "us," or "our"). By accessing this website and placing orders, you ("buyer," "you," or "your") agree to be bound by these Terms of Service, including all policies referenced herein.

2. Products & Descriptions

We make every effort to describe our products accurately. However, we do not warrant that product descriptions, pricing, or other content on this site is accurate, complete, or error-free. If a product you receive is materially different from its description, please contact us within the applicable inspection window (see our Returns & Refunds Policy).

3. Pricing & Payment

All prices are in U.S. Dollars (USD).
We reserve the right to correct pricing errors. If an item's correct price is higher than the listed price, we will contact you before processing the order.
Payment is processed at the time of purchase through Shopify's secure payment platform.
Wholesale and pallet orders above $2,000 may require a purchase order or wire transfer. Contact us for details.

4. Liquidation & As-Is Purchases

Products marked as "liquidation," "as-is," or sold as pallets/lots are sold under the terms described in our Liquidation & As-Is Disclaimer. These purchases are final sale with a 72-hour inspection window for material discrepancies only.

5. Resale Rights & First Sale Doctrine

All products sold through Thrive Outlet are genuine, legally acquired merchandise. Under the First Sale Doctrine (17 U.S.C. § 109), buyers have the legal right to resell products purchased from us through any channel, including Amazon, eBay, retail stores, flea markets, or other venues. We provide manifests and documentation to support your resale operations when available.

6. Shipping & Delivery

Shipping terms are described in our Shipping Policy. Risk of loss and title for items pass to you upon delivery to the carrier.

7. Returns & Refunds

Returns and refunds are governed by our Returns & Refunds Policy. Retail items may be returned within 15 days. Wholesale and liquidation purchases are final sale with a 72-hour inspection window.

8. Wholesale & Bulk Buyer Terms

Net 30 terms may be available for qualified wholesale buyers upon credit approval. Contact us to apply.
Minimum order quantities may apply for certain product lines.
Wholesale pricing is not combinable with other promotions or discounts unless explicitly stated.

9. Limitation of Liability

To the maximum extent permitted by law, Thrive 3PL LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of products from this site. Our total liability for any claim arising from a transaction shall not exceed the purchase price of the product(s) in question.

10. Governing Law

These Terms of Service are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas.

11. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the site after changes constitutes acceptance of the updated terms.
